Understanding Florida's Dog Bite Law

Under Florida’s dog bite Statute 767.04, the owner does not need to have prior knowledge of the dog’s viciousness or propensity to bite. What this means is that the owner can be held “strictly liable” for injuries caused by the animal, even if the events were unforeseeable or unpredictable. The dog bite laws in Florida take into consideration various factors, including the following:

    • Whether the attack occurred on private or public property

    • Whether or not the victim was lawfully present on the property

    • Whether the dog was provoked by the victim

    • If the victim provoked the animal, the extent of that negligence

    • Whether the victim was under six years old

    • Whether there was an easily readable warning sign including the words “Bad Dog”

Dog Bite Injuries and Private Property

Many dog bites occur on the private property belonging to the owner of the dog. The question to be addressed is whether the victim had express or implied consent to be there. This commonly includes:

    • U.S. Postal Service delivery personnel

    • Private delivery services such as employees of UPS, Federal Express

    • Workers on the site, such as roofers, tree cutters, construction personnel, home care workers, etc.

As well, those who were invited by the property owner fall under the purview of the protection of the statute.

Dog Bites and Workers' Compensation

In many instances an employee who was bitten or attacked on private property while performing their normal duties may be covered by their Workers' Compensation coverage. Additionally, depending on the circumstances, a third party claim against the owner of the dog may be possible. This may provide compensation such as pain and suffering that would not normally be available in a Workers’ Compensation claim.

Dog Bite Insurance Policies

Other aspects to be considered include whether the responsible party’s homeowner or rental policy covers dog and animal attacks, whether the landlord or property management company can be held liable, whether an automobile policy may come into effect if an attack occurred, for example, when a dog jumped out of a car or off the back of a truck, or whether the owner has an animal policy.
